In short. An LOC for bank loan default alone, without a criminal case, is on weak legal ground today. The Bombay High Court struck down the power of public sector bank chiefs to request LOCs in 2024, and the Delhi High Court has followed that ruling while the Supreme Court appeal is pending. This guide is for borrowers, directors and guarantors stopped at an airport or worried about it. A writ challenge in the High Court usually gets a first hearing within days. Start by finding out which agency asked for the LOC.
Is this your situation?
- You were stopped at IGI or another airport and told an LOC was opened at a bank's request.
- Your company's loan account has turned NPA and you are a director or promoter who travels for work.
- You signed a personal guarantee for a relative's or friend's business loan that has defaulted.
- The bank has declared the account fraud or named you a wilful defaulter and you fear a travel ban.
- You live abroad and cannot return to your job because you were stopped while leaving India.
- You have settled the loan under a one-time settlement but the LOC has not been withdrawn.
- There is a CBI or ED case about the loan and you want to know whether the LOC can be challenged.
Key points
- Find out who asked for it. An LOC requested by a bank's chairman or managing director stands on a different footing from one opened by the CBI, ED or SFIO in a criminal case.
- Default alone is usually not enough. Courts have repeatedly said that non-repayment of a loan, without more, does not justify stopping a person from leaving India.
- The law is in flux. The Bombay High Court's 2024 ruling against bank-requested LOCs is under appeal in the Supreme Court without a stay, and the Delhi High Court has followed it in 2026.
- Expect conditions, not a free pass. Even when an LOC is quashed, courts often ask for undertakings to cooperate, travel details or prior permission from a court where a case is pending.
- Move quickly but completely. An urgent writ with the right documents, filed within days, is far more effective than letters to the bank that go unanswered.
The short answer: is an LOC for bank loan default lawful?
A Look Out Circular is an alert in the immigration system that tells officers at airports, seaports and land borders to stop, detain or report a person. It is not a court order. It is opened by the Bureau of Immigration on the request of an 'originating agency' named in the Ministry of Home Affairs guidelines, now consolidated in an office memorandum of 22 February 2021.
Under those guidelines, an LOC is meant for people involved in cognizable offences who are evading arrest or trial. The guidelines also allow it in exceptional cases where the person's departure would be detrimental to the sovereignty, security or integrity of India, to friendly relations with a foreign country, to the economic interests of India or to the larger public interest. An amendment in 2018 added the chairmen, managing directors and chief executives of public sector banks to the list of officers who can ask for one.
That 'economic interests of India' clause is how banks began requesting LOCs against defaulting borrowers, directors and guarantors who had no criminal case against them. People sometimes call this an LOC by bank or an economic interest LOC. Courts have been increasingly sceptical of it, and as of October 2026 the position in both the Bombay and Delhi High Courts is that LOCs requested by public sector bank chiefs under that clause do not survive judicial review.
The answer is different where there is a criminal case. If the CBI, the ED, the SFIO or the Economic Offences Wing has registered a case about the loan and opened the LOC itself, the challenge has to be fought on the facts of that investigation.
The rules and rulings that govern bank-linked LOCs
MHA Office Memorandum, 22 February 2021
The consolidated guidelines on LOCs. They list the originating agencies, the grounds on which an LOC may be opened, the format of the request and the obligation of the originating agency to review and withdraw it. The person is generally not told in advance.
Article 21 of the Constitution
Since Maneka Gandhi v. Union of India (1978), the right to travel abroad has been treated as part of personal liberty. It can be restricted only by a procedure established by law that is fair, just and reasonable, which is the foundation of every LOC challenge.
Sumer Singh Salkan v. Asstt. Director (Delhi High Court, 2010)
One of the first rulings to set out when an LOC can be opened: broadly, in cognizable offences where the accused is deliberately evading arrest or not appearing before the trial court despite a non-bailable warrant. Later guidelines and judgments build on it.
Viraj Chetan Shah v. Union of India (Bombay High Court, 2024)
Struck down the clause permitting public sector bank chiefs to request LOCs, and held that a bank's financial interest cannot simply be equated with the economic interests of India. The Union's appeal is pending in the Supreme Court, which has not stayed the judgment.
Bank of Baroda v. Vineet Gupta (Delhi High Court, Division Bench, July 2026)
Dismissed a bank's appeal against a single judge's order quashing LOCs against promoters of a defaulting company. Relying on Viraj Chetan Shah and on an earlier Delhi High Court ruling in Bank of Baroda v. Surender Kumar Bansal (2026), the court treated an LOC as an exceptional coercive measure and held that one opened at a bank chief's request would not withstand scrutiny.
RBI directions on fraud and wilful defaulters
The Reserve Bank's master directions on fraud risk management (2024) and on wilful defaulters (2024) govern how banks classify accounts. Following State Bank of India v. Rajesh Agarwal (2023), a borrower must be heard before the account is classified as fraud.
What the courts have actually decided
The Bombay High Court's decision in Viraj Chetan Shah in April 2024 is the starting point. A Division Bench examined a large batch of petitions by borrowers, directors and guarantors and held that the power given to public sector bank chiefs was arbitrary and outside what the guidelines could lawfully allow. It quashed the LOCs before it that rested only on bank requests. It made clear that its ruling did not affect orders passed by courts or tribunals restraining a person from leaving India, or LOCs issued by other agencies in criminal cases.
The Union of India and several banks took the matter to the Supreme Court. Those appeals were pending in October 2026, but the judgment has not been stayed. That point matters, because the Delhi High Court has relied on it. In July 2026, a Division Bench of the Delhi High Court dismissed an appeal by Bank of Baroda against an order quashing LOCs against two promoters, holding that, in the absence of a stay, an LOC requested by a bank chief would not stand. The bank's argument that the Bombay ruling was not final did not change the result.
Even before these rulings, the Delhi High Court had in many cases quashed or suspended bank-requested LOCs against guarantors and non-executive directors where there was no criminal case and no sign that the person was trying to flee. Courts asked a simple question: what is the material showing that this person's departure would harm the economy of the country, as opposed to the balance sheet of one bank?
The law could change. If the Supreme Court reverses Viraj Chetan Shah, banks may again be able to request LOCs in some cases. Anyone facing an LOC for bank loan default should check the current position at the time of filing, and a petition should be drafted so that it succeeds on its own facts as well as on the larger point.
When a loan-linked LOC can still stand
The rulings against bank-requested LOCs do not protect everyone connected with a defaulted loan. Where the loan has become the subject of a criminal case, the investigating agency can open an LOC in its own right. Bank fraud FIRs registered by the CBI, money-laundering cases by the ED, company fraud investigations by the SFIO and cheating cases by the Delhi Police EOW all fall in this category.
An agency LOC is tested against the criminal-law standard: is the person an accused, is he cooperating with the investigation, has he been summoned and failed to appear, is there a real risk he will not return? A director who joins investigation every time he is called, whose family and assets are in India, and who has a genuine business reason to travel, may still get the LOC suspended or quashed, usually with conditions. The service page on getting a Look Out Circular quashed or suspended deals with these agency LOCs in detail.
A court or tribunal hearing a recovery case can also restrain a borrower from leaving India by its own order, and the 2024 Bombay ruling expressly left such orders untouched. The remedy against them lies in an application or appeal in that forum, not a writ against the LOC.
Finally, large amounts and a history of evasion change how courts weigh the matter. A borrower who has stopped responding to the bank, moved assets abroad and missed hearings in the Debts Recovery Tribunal will find the court much less sympathetic, whoever requested the LOC.
Directors, guarantors and family members
Many people stopped at airports were never the borrower. They are guarantors who signed a personal guarantee years ago, independent or nominee directors, directors who resigned before the default, or spouses whose only connection is a joint property. For them, the argument against an LOC is usually strongest.
A guarantor's liability is civil. The bank can sue him in the Debts Recovery Tribunal, enforce security under the SARFAESI Act or, for personal guarantors of companies in insolvency, start proceedings under the Insolvency and Bankruptcy Code. None of those remedies needs him to stay in the country. Courts have repeatedly said that a coercive measure affecting fundamental rights cannot be used as a recovery tool.
A non-executive or independent director who had no role in borrowing decisions is in a similar position. A director who resigned before the default should have the Form DIR-11 and the company's Form DIR-12 filed with the Registrar of Companies ready, because that one document often answers the bank's case.
If the bank has also classified the account as fraud or named you a wilful defaulter, that tag can be challenged separately. Our guide on whether a bank can declare your account fraud without hearing you and the page on challenging a fraud or wilful defaulter tag explain that remedy.
Step by step: challenging an LOC opened for a bank loan
Most people learn of the LOC at the airport. These steps assume you have just been stopped or have been told an LOC exists.
Note what the immigration officer tells you
Ask which agency requested the LOC and write down the officer's words, the date, time and airport. If you are given any slip or intimation, keep it. Keep your boarding pass and cancelled ticket as proof of the travel you lost.
Write to the bank and the agency at once
Send an email and a letter to the bank's branch, its recovery department and the officer who requested the LOC, asking for a copy of the request and the reasons. If an agency is named, write to it too. Even if they do not reply, the letters show you acted promptly.
Collect the loan and company papers
Gather the sanction letter, guarantee deed, NPA notice, any DRT or SARFAESI papers, settlement correspondence, and your proof of residence, family and assets in India. Directors should add resignation filings and board records.
Check for a criminal case
Search for any FIR, ECIR or complaint naming you, and any summons. If there is one, the challenge must address it; if there is none, the petition should say so clearly on affidavit.
File a writ petition under Article 226
The petition names the Union of India through the Ministry of Home Affairs, the Bureau of Immigration and the bank or agency. It seeks quashing of the LOC and, as interim relief, its suspension or permission to travel on dates you specify.
Seek urgent listing if travel is imminent
If you have a fixed date for a job, a medical need or a family event, the petition can be mentioned for urgent listing. Our guide on urgent listing and mentioning in the Delhi High Court explains how that works.
Comply with conditions and get the record updated
If the court suspends or quashes the LOC on conditions, give the undertakings promptly and send a copy of the order to the Bureau of Immigration and the bank. Carry a certified or downloaded copy of the order when you travel.
Which High Court should hear the challenge?
An LOC is opened by the Bureau of Immigration, which functions under the Ministry of Home Affairs in New Delhi. Because part of the cause of action arises where the LOC is issued and maintained, the Delhi High Court has often entertained LOC petitions from people living outside Delhi under Article 226(2). Our guide on filing a writ in the Delhi High Court if you live outside Delhi explains that clause.
That said, courts apply the principle of forum conveniens set out in Kusum Ingots v. Union of India (2004). If the borrower, the bank branch, the loan, the requesting officer and any criminal case are all in Mumbai or Chennai, the Delhi High Court may ask why the petition was not filed in the High Court there. A petition is stronger when there is a real Delhi connection: the bank's requesting office is in Delhi, the borrower lives or works in Delhi or NCR, the person was stopped at IGI airport, or the agency that opened the LOC is headquartered here.
Where there is a pending criminal case, permission to travel for a particular trip may also be sought from the trial court under its bail conditions. That is a separate remedy covered in our guide on travelling abroad when a criminal case is pending, and the two are often pursued together.
Time and cost for an LOC challenge
| Stage | Typical time | Court fee and expenses (general) |
|---|---|---|
| Letters to the bank and agency asking for reasons | Send within 1 to 3 days; replies often slow or absent | Postage only |
| Drafting and filing the writ petition | 2 to 7 days, depending on how quickly papers are available | Small fixed court fee; check the current court fee and printing costs |
| Urgent mentioning and first hearing | Same week if urgency is shown; otherwise 1 to 3 weeks | No separate fee |
| Interim order suspending the LOC or permitting travel | Often at the first or second hearing if the case is clear | Any security or deposit the court may require |
| Final decision on quashing | A few weeks to several months | Certified copies |
| Appeal by the bank or Union (LPA) | Months, if filed | Court fee for the respondent's side is minimal |
| Lawyer's fees | Depends on urgency and complexity | Discussed at the first meeting and agreed in writing, stage by stage |

What the Delhi High Court usually orders
Outcomes in LOC cases are seldom all or nothing. Where the LOC rests only on a bank's request and there is no criminal case, the court may quash it outright, especially after the 2026 Division Bench ruling. Where facts are disputed or there is an investigation, the court more often suspends the LOC for a particular trip, or allows travel on conditions, while the main petition is heard.
Common conditions include an undertaking to return on a fixed date, a detailed itinerary with addresses and phone numbers abroad, an undertaking to cooperate with any investigation and appear when called, a fixed deposit or security in some cases, and, where a criminal case is pending, prior permission from the trial court before each trip. The Delhi High Court's July 2026 ruling noted that the single judge's conditions of this kind adequately protected the bank.
Advocate B.K. Singh's practical tip in LOC matters is to offer the court what it will ask for before it asks: a return ticket, an itinerary, an affidavit of assets in India and an undertaking to appear. A petitioner who walks in with these ready often gets an interim order on the first date instead of a short adjournment for the bank to file a reply.
What the bank can do instead, and when settling makes sense
Banks have strong recovery tools that do not involve stopping anyone at an airport. They can file an original application in the Debts Recovery Tribunal, enforce security under the SARFAESI Act, invoke personal guarantees, and start insolvency proceedings against corporate debtors and personal guarantors, which go to the NCLT. For borrowers dealing with that side of the dispute, our network site on NCLT and insolvency cases covers it in detail.
Quashing the LOC does not reduce the debt by a rupee. It only restores your freedom to travel while the recovery proceeds. A borrower who uses the relief to disappear will find the next court far less patient, and may face criminal proceedings that support a fresh LOC from an investigating agency.
If you are close to a settlement, use it. A one-time settlement accepted by the bank, with a no-dues letter, is the cleanest way out. Ask the bank in writing to request withdrawal of the LOC, keep the letter and follow up with the Bureau of Immigration. LOCs are not always withdrawn promptly after settlement, and a short writ petition may still be needed to get the record cleared.
If you work or live abroad
NRIs and Indians working abroad face the sharpest version of this problem. A visit home for a wedding turns into an indefinite stay when immigration stops them on the way out, and their job, visa and family abroad are put at risk. In such cases urgency is genuine and the court will usually hear the matter quickly if the petition shows the date by which the person must return.
The petition should show your residence and employment abroad, your record of returning to India, and why your presence abroad does not prejudice the bank: for example, that the security is with the bank, that you have offered to appear in the DRT through counsel or by video, and that you will return when required. A family member in India can coordinate papers, and a power of attorney can authorise a lawyer to act while you are travelling.
Advocate B.K. Singh advises clients abroad to check the LOC position through counsel before booking a trip to India if their company's loan has turned NPA. It is far easier to deal with an LOC from a desk than from an airport immigration counter at two in the morning.
A made-up example: the guarantor from Okhla
Here's a made-up example. Sunita runs a small export unit in Okhla. In 2019 she signed a personal guarantee for a working capital loan taken by her brother's garment company from a public sector bank. The company defaulted in 2023, the account became an NPA, and the bank filed a case in the Debts Recovery Tribunal. Sunita was never accused of any offence and has attended every DRT date through her lawyer.
In 2026, she is stopped at IGI airport on her way to a buyers' fair in Frankfurt. The immigration officer tells her an LOC was opened at the bank's request. She returns home, collects the guarantee deed, the DRT order sheets, her passport history and an invitation from the fair, and files a writ petition in the Delhi High Court against the Union of India, the Bureau of Immigration and the bank.
At the first hearing, the bank says she is liable for over Rs 4 crore and may not return. Her lawyer points out that there is no FIR, that she has property and a running business in Delhi, that she has travelled abroad and returned many times, and that bank-requested LOCs have been held unsustainable. The court suspends the LOC for the trip on her undertaking to return on a fixed date and to keep appearing in the DRT. Some weeks later it quashes the LOC, leaving the bank to pursue recovery in the tribunal.
Mistakes that weaken an LOC challenge
- Assuming the bank opened it. If an agency in a criminal case requested it, the argument is different and the petition must deal with the investigation.
- Hiding a criminal case. Courts treat suppression of a pending FIR or summons very seriously, and it can cost you the relief altogether.
- Going to the wrong High Court. Filing in Delhi with no real Delhi connection invites an objection on forum conveniens.
- Filing without travel details. A petition that does not say where you want to go, why and when you will return is harder to grant interim relief on.
- Treating relief as a settlement. Quashing the LOC does not touch the debt; ignoring the DRT afterwards can bring fresh trouble.
- Not following up after settlement. Get the bank's written request for withdrawal and check that the Bureau of Immigration has acted.
What to do this week
Write down exactly what you were told at the airport and which agency was named. Email the bank and that agency asking for the LOC request and reasons. Collect the guarantee deed, the loan papers, any DRT papers and your proof of roots in India. Check, through counsel if needed, whether any FIR or ECIR names you.
If you have a fixed travel date, move to the High Court without waiting for the bank's reply. The service page on quashing or suspending a Look Out Circular explains what the petition contains, and our general guide on what an LOC is and how to remove it covers non-bank LOCs as well.

Frequently asked questions
How do I know if there is an LOC against me before I travel?
There is no public database. Usually people learn of it at the airport. If your company's loan has turned NPA or there is an investigation, a lawyer can write to the bank or agency, and in some cases the court can be asked to direct disclosure of whether an LOC exists.
Can a private bank request a Look Out Circular?
The 2018 amendment named heads of public sector banks as originating authorities, not private banks. A private bank would ordinarily have to go through a criminal complaint and an investigating agency, or seek a travel restraint from a court or tribunal.
Can the DRT stop me from leaving India?
A tribunal or court hearing the recovery case can pass its own order restraining a party from leaving India in suitable cases. The 2024 Bombay ruling on bank-requested LOCs did not affect such orders, which must be challenged in that forum or by appeal.
Does an LOC expire after one year?
Under the current MHA guidelines an LOC generally remains in force until the originating agency asks for it to be withdrawn. Older guidelines had a one-year validity, but that is no longer the rule, so a court order or withdrawal is usually needed.
Can I be arrested at the airport because of a bank LOC?
A bank-requested LOC usually asks immigration to stop departure, not to arrest. Arrest needs a criminal case and legal grounds. If an agency LOC in a criminal case asks for detention, the person may be handed to that agency.
Will paying part of the loan get the LOC removed?
Part payment may help the court see that you are not running away, but it does not automatically remove the LOC. A full settlement with a no-dues letter and a written withdrawal request from the bank is the cleaner route.
Can my wife be stopped at the airport because of my company's loan?
Only if she is a borrower, guarantor or director, or is named in a criminal case. A spouse with no role in the loan should not be subject to an LOC, and if one exists it can be challenged quickly.
What if the Supreme Court reverses the Bombay High Court ruling?
Then banks may again be able to request LOCs on economic-interest grounds, subject to the guidelines and judicial review. Even then, courts would still examine whether there is real material that your departure harms the country's economic interest, not just the bank's dues.
