In short. This page lists every kind of case we take to the Delhi High Court: bail and criminal remedies, ED and CBI matters, writs against the government, service and education disputes, property and civil suits, family appeals, rent, commercial, IP and tax cases. Use it to find out whether your problem belongs in the High Court at all, which bench hears it, and roughly how long the first stage takes. Most urgent matters get a first hearing within days to a few weeks. Your next step is to collect your papers and read the page for your case type.
Is this your situation?
- A lower court in Delhi has refused bail, framed charges or passed an order you think is wrong.
- Police, the ED, the CBI or customs have registered a case, sent a summons or frozen an account.
- A government department, the DDA, the MCD or a university has acted against you and there is no other remedy.
- You have a property, money or business dispute worth more than Rs 2 crore.
- A family court in Delhi has decided your divorce, custody or maintenance case and you want to appeal.
- Someone is copying your brand, or the tax or GST department has passed an order you cannot accept.
- You are not sure whether your case belongs in the High Court, a district court or a tribunal.
Three ways a case reaches the Delhi High Court
A case comes to the Delhi High Court in one of three ways. It can start there, which happens with civil and commercial suits valued above Rs 2 crore, probate of large estates, and most intellectual property suits. It can come as a writ petition under Article 226 or 227 of the Constitution against the government, a public body or a lower court. Or it can come up from below, as a bail application after the sessions court says no, a revision, or an appeal against a district court, family court or tribunal order.
Knowing which of the three applies tells you a lot. A suit on the original side follows the Delhi High Court (Original Side) Rules 2018 and spends months before a Joint Registrar on pleadings and documents. A writ petition is decided mostly on affidavits and arguments, often without oral evidence. An appeal or revision is argued on the record of the lower court, which is why the certified copy of that court's order and file matters so much.
This is the website of a private law firm, B.K. Singh & Associates. It is not the Delhi High Court's official website. Case status, cause lists, e-filing and official notices are on the court's own website.
Which bench hears your case and why
The Delhi High Court was set up under the Delhi High Court Act 1966 and sits at Sher Shah Road, New Delhi. The Chief Justice fixes a roster that assigns subjects to benches, and the roster changes from time to time. Single judges hear most bail applications, FIR quashing petitions, criminal and civil revisions, Article 227 petitions, writs filed by individuals, and suits on the original side. Division Benches of two judges hear public interest litigation, writs against CAT orders, Letters Patent Appeals against single judge judgments, income tax appeals, appeals from family courts, and appeals under the NIA Act.
Two specialised wings matter for business clients. The Commercial Division hears commercial suits above Rs 2 crore under the Commercial Courts Act 2015. The Intellectual Property Division, set up after the IP Appellate Board was abolished in 2021, hears trade mark, copyright, patent and design matters under the IPD Rules 2022, including appeals from the Registry and the Patent Office.
Territorial jurisdiction is decided by Article 226(2): the Delhi High Court can hear a writ if the cause of action arose wholly or partly in Delhi, or if the authority acting against you is located here. Living in Delhi is not enough on its own, and Kusum Ingots v. Union of India (2004) allows the court to send you to a more appropriate High Court. Criminal matters follow the place of the FIR or trial: a Gurugram FIR goes to the Punjab and Haryana High Court, a Noida FIR to the Allahabad High Court. For suits, the guide on the Rs 2 crore rule in Delhi explains when you start in the High Court and when in a district court; the limit is above Rs 2 crore, but check the current figure before filing.
Bail and custody
Bail work is the largest part of our criminal practice in the High Court. Regular bail under Section 483 BNSS (old Section 439 CrPC) is usually sought after the sessions court has refused it, and the High Court looks at the nature of the accusation, the evidence collected, the period already spent in custody, the stage of trial, and the risk of the accused fleeing or influencing witnesses. Our page on bail from the Delhi High Court covers the procedure.
Anticipatory bail under Section 482 BNSS (old Section 438 CrPC) protects a person before arrest. Sushila Aggarwal v. State (NCT of Delhi) (2020) held that this protection is not ordinarily limited in time. See anticipatory bail in the Delhi High Court. We also handle default bail when the chargesheet is not filed in 60 or 90 days, interim bail for surgery or a family emergency, suspension of sentence during an appeal, bail cancellation, parole and furlough for prisoners in Tihar, Mandoli and Rohini jails, and bail in special statutes such as POCSO, NDPS and UAPA.
When Advocate B.K. Singh reads a bail file, he checks the date of arrest, whether the chargesheet has been filed, and what the sessions court actually said in its rejection order. Those three facts decide whether a fresh application in the High Court is likely to be heard on merits or sent back.
Quashing an FIR and protection from police action
Section 528 BNSS (old Section 482 CrPC) lets the High Court quash an FIR or criminal proceeding where the allegations, taken as true, disclose no offence, where the dispute is purely civil, or where the case is an abuse of process. The categories in State of Haryana v. Bhajan Lal (1992) still guide the court. Our page on how to quash a false FIR in the Delhi High Court explains what the petition must show.
Quashing after settlement is a separate route: matrimonial cruelty cases, cheque bounce cases and many commercial disputes are quashed when the parties have genuinely settled, following Gian Singh (2012) and Narinder Singh (2014), though serious offences against society are generally not quashed on compromise (Parbatbhai Aahir, 2017). In the same group sit Look Out Circular challenges, permission to travel abroad, release of bank accounts frozen by cyber police, release of seized cars and phones, cancellation of non-bailable warrants and proclamations, police protection for couples who married by choice, habeas corpus, and transfer of investigation to another agency.
ED, CBI, customs and other agency cases
Many central agency investigations begin in Delhi, because the agencies' head offices and the special courts at Rouse Avenue are here. We advise on ED summons under Section 50 PMLA, ECIRs, provisional attachment under Section 5, arrest under Section 19 and bail under Section 45, as well as CBI notices, sanction under Section 19 of the Prevention of Corruption Act, and trials before the special judges. Start with our page on ED summons, ECIR and property attachment.
Customs and DRI cases at IGI Airport, gold and currency seizures, COFEPOSA detention, SFIO investigations into company fraud, and bank fraud classification all fall in this group. These cases move on several fronts at once: a criminal case, an attachment or adjudication proceeding, and sometimes a writ. The first meeting should cover all of them, not only the one with the nearest date.
Criminal appeals and revisions
Appeals against conviction from Delhi sessions courts and special courts lie to the High Court under Section 415 BNSS (old Section 374 CrPC), with suspension of sentence under Section 430 BNSS. Appeals against acquittal under Section 419 BNSS (old 378) need leave in many cases, and victims have their own appeal right under Section 413 BNSS. Our page on appeals against conviction in the Delhi High Court sets out the timelines.
Revision under Sections 438 to 442 BNSS (old 397 to 401) is used against summoning orders, orders framing charge, refusals to discharge and some interim orders. We also handle cheque bounce appeals and revisions, SC/ST Act appeals under Section 14A, and premature release of life convicts. Most of this work depends on reading the trial record closely; the certified copy of the judgment and the evidence are where an appeal is won or lost.
Writs against the government, and service and education cases
A writ petition under Article 226 asks the High Court to correct an illegal or arbitrary act of the Central Government, the Delhi Government, the MCD, the DDA, the Delhi Police, a public sector company, a university or another public body. Common examples are passport refusal or impounding, OCI cancellation, MCD sealing and demolition, DDA allotment disputes, police refusal to register an FIR, RTI orders of the Central Information Commission, electricity and water billing by BSES, Tata Power and the Delhi Jal Board, arms licences, and bank fraud or wilful defaulter tags. Contempt petitions to enforce court orders and PILs on public issues sit here too. See our page on a writ petition against the Central or Delhi Government.
Service cases follow their own routes. Central and Delhi government civil employees go first to the Central Administrative Tribunal, and the CAT's order is then challenged before a Division Bench of the High Court, as L. Chandra Kumar v. Union of India (1997) requires. Personnel of the BSF, CRPF, CISF, ITBP and SSB are outside the CAT and file directly in the High Court; see service cases for CAPF personnel. Education disputes include EWS admissions under Section 12(1)(c) of the Right to Education Act, private school fee disputes, DU, GGSIPU and JNU result and degree cases, NEET and medical admission disputes, and teacher termination in recognised private schools.
One rule cuts across this group: if a statute gives you an appeal, the High Court will usually ask why you did not use it. Many writs fail for that reason alone, so the first question we ask is whether a tribunal or appellate authority should hear the matter before the High Court does.
Property, civil and rent cases
Property suits valued above Rs 2 crore start on the original side of the High Court: partition among family members, declaration and cancellation of sale or gift deeds obtained by fraud, specific performance where a seller backs out, injunctions against illegal sale or construction, recovery of money, and civil defamation. Below that value, the suit goes to the district court and may reach the High Court in first appeal under Section 96 CPC, second appeal under Section 100 CPC, or a challenge under Article 227. Our page on property suits above Rs 2 crore explains the original side process.
Probate and letters of administration also come to the High Court when the estate exceeds the pecuniary limit. Daughters' coparcenary rights after Vineeta Sharma v. Rakesh Sharma (2020), and the rule in Suraj Lamp (2011) that GPA sales do not pass title, come up often in Delhi family property disputes.
Rent cases have their own track. For premises let at up to Rs 3,500 a month, the Delhi Rent Control Act 1958 applies, and an eviction order for bona fide need under Section 25B cannot be appealed but can be challenged by revision in the High Court; see eviction orders and revision in the Delhi High Court. Premises outside the Act, including most new commercial lettings, are dealt with by ordinary suits for possession and mesne profits.
Family appeals
Judgments and orders of Delhi's family courts in divorce, judicial separation, custody and maintenance are appealed to the High Court under Section 19 of the Family Courts Act 1984 within 30 days. Maintenance orders under Section 144 BNSS (old Section 125 CrPC) are challenged by revision. Orders under the Domestic Violence Act 2005 go first by appeal under Section 29 to the sessions court, and then to the High Court. Read our page on an appeal against a family court order.
We also handle child custody and habeas corpus for a child, guardianship under the Guardians and Wards Act 1890, transfer of matrimonial cases, NRI divorces and foreign decrees, and quashing of matrimonial FIRs after settlement. The Delhi High Court Mediation and Conciliation Centre, Samadhan, settles a large number of these disputes, and the court often refers parties there on the first date. A settlement there can resolve the divorce, maintenance and criminal case together.
Commercial and arbitration cases
Commercial disputes of a specified value of Rs 3 lakh and above fall under the Commercial Courts Act 2015. In Delhi, those above Rs 2 crore go to the Commercial Division of the High Court. Pre-institution mediation under Section 12A is mandatory unless urgent interim relief is sought, as the Supreme Court held in Patil Automation (2022), and the written statement must be filed within 120 days. Our page on commercial suits above Rs 2 crore covers the procedure, including summary suits under Order 37.
Arbitration work in the High Court covers interim measures under Section 9, appointment of an arbitrator under Section 11, challenges to awards under Section 34 within three months plus up to 30 days, appeals under Section 37, and enforcement of awards as decrees under Section 36. Execution of decrees and awards, commercial appeals under Section 13, and tenancy disputes over commercial premises complete this group.
Trade mark, copyright and IP cases
The Delhi High Court hears a large share of India's IP litigation. Trade mark infringement and passing off suits, copyright and piracy cases including dynamic injunctions against mirror websites, patent and design infringement, domain name disputes, and personality rights cases against deepfakes and unauthorised use of a person's name or image are all filed here. Start with our page on trade mark infringement and passing off suits.
Since the Tribunals Reforms Act 2021, rectification of trade marks under Section 57 of the Trade Marks Act 1999, appeals from the Registrar under Section 91, and patent appeals under Section 117A of the Patents Act 1970 are heard by the High Court. In an infringement case speed matters: the longer the copier stays in the market without objection, the harder it is to obtain an interim injunction.
Income tax, GST and customs cases
The Income-tax Act 2025 replaced the 1961 Act from 1 April 2026, but earlier years and pending proceedings still follow the 1961 Act. Writs against reassessment notices, searches, bank attachments and refund delays are common, and the law on reassessment was reshaped by Union of India v. Ashish Agarwal (2022) and Union of India v. Rajeev Bansal (2024). Appeals from the ITAT on substantial questions of law go to a Division Bench under Section 260A of the 1961 Act for those years. See income tax notices, reassessment and search writs.
GST cases include cancellation of registration under Section 29 of the CGST Act 2017, refusal of revocation under Section 30, and provisional attachment of bank accounts under Section 83, which the Supreme Court limited in Radha Krishan Industries (2021). Customs appeals from CESTAT come to the High Court under Section 130 of the Customs Act, except classification and valuation matters, which go to the Supreme Court.
How a Delhi High Court case runs with us, from first call to first hearing
First conversation
You call or WhatsApp us, or book an online consultation. We ask what happened, what papers you have and whether there is a date or deadline coming. If the matter is urgent, such as an arrest, a demolition notice or an LOC at the airport, we say so at once.
Reading the papers
We read the FIR, order, notice or contract before giving an opinion. This is where forum questions are settled: High Court or district court, writ or appeal, Delhi or another state. Sometimes the honest answer is that the High Court is not the right place yet.
Engagement in writing
Fees are discussed at the first meeting and agreed in writing, stage by stage. Court fee, typing, certified copies and notarisation are explained separately. You sign a vakalatnama in our favour.
Drafting and filing
We draft the petition, application, suit or appeal with you, collect affidavits, and file it through the High Court's e-filing system. The Registry then checks it and may raise objections, which we cure and refile.
Listing and first hearing
Fresh matters are listed according to the court's listing rules; urgent ones can be mentioned for early listing. On the first date the court may issue notice to the other side, grant interim relief, refer the parties to mediation, or dismiss the matter at the threshold.
Updates and next steps
After every hearing we tell you what happened and what the order says, and send the order once uploaded. Before each date we tell you what is needed from you. If the matter is decided against you, we explain the review, appeal or Supreme Court options and their time limits.

A made-up example: one business owner, three different routes
Here's a made-up example. Meena runs a packaging unit in Okhla. In the same month she faces three problems: her GST registration is cancelled for not filing returns during a period when she was in hospital, a competitor in Bawana starts selling cartons under a name almost identical to her brand, and a customer's cheque of Rs 18 lakh bounces.
Each goes to a different place. The GST cancellation goes first to the appellate authority under the CGST Act; if that route is closed or the order is plainly without a hearing, a writ in the Delhi High Court is possible. The brand copying goes straight to the IP Division of the High Court as a trade mark and passing off suit, because the value of her brand and the reliefs are above the district court limit, and she needs an interim injunction quickly. The cheque bounce is a complaint before a magistrate under the Negotiable Instruments Act, not a High Court matter at all, unless a revision or quashing question arises later.
When Advocate B.K. Singh sees a client like Meena, he sorts the problems by deadline first, because the GST appeal and the cheque bounce notice both run on fixed time limits. The trade mark suit is prepared in parallel, with sales records and proof of first use gathered before filing. None of this guarantees an outcome, but it keeps any of the three from being lost on time.
Common mistakes before coming to the High Court
- Skipping the lower court. The High Court usually expects bail to be sought from the sessions court first and statutory appeals to be used before a writ.
- Missing limitation. Family court appeals have 30 days, first appeals generally 90 days, Section 34 challenges three months plus up to 30 days, and contempt one year. Delay can sometimes be condoned, but only with a real explanation.
- Filing in the wrong state. A Delhi address does not make every case a Delhi High Court case. FIRs and decisions in Haryana or UP usually go to those states' High Courts.
- Coming without the order. A High Court challenge needs the actual order, preferably a certified copy, not a description of it.
- Hiding earlier litigation. Every petition must disclose earlier cases on the same facts. Concealment can lead to dismissal with costs.

Frequently asked questions
Can I go directly to the Delhi High Court without going to a lower court?
For writs, FIR quashing, IP suits and civil or commercial suits above Rs 2 crore, yes. For bail, the High Court generally expects you to approach the sessions court first, and statutory appeals must usually be used before a writ.
How do I know if my case is in the Delhi High Court or another High Court?
Criminal cases follow the place of the FIR or trial. Writs follow Article 226(2): the cause of action must arise at least partly in Delhi, or the authority must be located here. Your home address alone does not decide it.
What is the pecuniary limit of the Delhi High Court?
Civil suits valued above Rs 2 crore are filed on the original side of the High Court; smaller suits go to district courts. Check the current limit before filing, as it is set by statute.
Does the Delhi High Court hear cases from Noida and Gurugram?
Usually not. Noida matters go to the Allahabad High Court and Gurugram matters to the Punjab and Haryana High Court, unless part of the cause of action arose in Delhi or a central authority in Delhi passed the order.
How long does it take to get a first hearing in the Delhi High Court?
Urgent matters such as bail, demolition or LOCs can often be listed within days, and the court allows urgent mentioning. Routine matters usually get a first date within a few weeks of clearing Registry objections.
Can I attend Delhi High Court hearings online?
The court allows hybrid and video hearings in many matters, subject to its current directions. Your lawyer will tell you whether your personal presence is needed on a particular date.
What does a Delhi High Court lawyer charge?
Fees depend on the type of case, its urgency and the stages involved. We discuss fees at the first meeting and agree them in writing, stage by stage; court fee is separate and set by law.
Can an NRI file a case in the Delhi High Court from abroad?
Yes. An NRI can sign the vakalatnama and affidavits abroad before a notary or the Indian embassy, or give a power of attorney to a relative. Many hearings can be attended by video.
