Article 226(2) of the Constitution and the Delhi High Court Act 1966: when a Gurugram case goes to the Delhi High Court and when to the Punjab and Haryana High Court

Delhi High Court Lawyer for Gurugram: Delhi or Chandigarh?

Gurugram resident or company with a Delhi FIR, a Delhi arbitration or a central order? When the Delhi High Court hears it and when Chandigarh is the forum.

In short. Gurugram is in Haryana, so its own High Court is the Punjab and Haryana High Court at Chandigarh. But if the FIR is registered in Delhi, the case is pending in a Delhi court, the arbitration is seated in New Delhi or the order was passed by an authority in Delhi, the Delhi High Court hears it, wherever you live. Bail pleas are listed within days; writs and commercial cases run for months or years. Send us the FIR, order or contract and we will tell you which High Court is right before anything is filed.

Is this your situation?

  • You live or work in Gurugram and an FIR has been registered against you by Delhi Police
  • Your wife has gone back to her parents in Delhi and filed a dowry or cruelty complaint there
  • Your Gurugram company has a contract with a Delhi jurisdiction clause or an arbitration seated in New Delhi
  • Someone is copying your brand and you want to sue in Delhi
  • Customs at IGI Airport has seized goods or detained you on your return
  • You are a CAPF member posted near Gurugram or Manesar and your force headquarters in Delhi passed an order against you
  • You cannot tell whether your case belongs in Delhi or Chandigarh

Two High Courts, thirty kilometres apart

Gurugram and Delhi share a metro line, an airport and a workforce, but they are in different states and answer to different High Courts. Cases that arise in Gurugram, with Gurugram police, the Haryana government, the Municipal Corporation of Gurugram, HSVP, DTCP or the Gurugram district courts, go to the Punjab and Haryana High Court at Chandigarh, about 250 km away. Cases that arise in Delhi go to the Delhi High Court at Sher Shah Road, about an hour's drive from Cyber City.

Your residence does not decide which of the two hears your case. A family living in DLF Phase 2 can have one matter in Delhi and another in Chandigarh in the same year. What matters is where the case is pending, where the order was passed, and where the events at the heart of the dispute took place.

The law that draws the line

Article 226(2), Constitution of India

A High Court may issue writs where the cause of action arises wholly or in part within its territory, even if the authority or person is located elsewhere. A Gurugram resident can therefore challenge an order passed in Delhi before the Delhi High Court.

Kusum Ingots v. Union of India (2004) and forum conveniens

The Supreme Court held that the seat of the Union Government in Delhi does not by itself give the Delhi High Court jurisdiction over every central order, and that a court may decline a case where only a small part of the cause of action arose within its limits. The Delhi High Court applies this regularly to petitions with thin Delhi links.

Delhi High Court Act 1966

The Delhi High Court supervises courts and tribunals in the National Capital Territory of Delhi only. It cannot correct an order of the Gurugram sessions court, HRERA Gurugram or a Haryana labour court.

Section 20 CPC and jurisdiction clauses

Civil suits can be filed where the defendant lives or works or where the cause of action arose. Where two courts both have jurisdiction, parties may agree to go to one of them, and the Supreme Court in Swastik Gases v. Indian Oil Corporation (2013) upheld such a clause even without the word exclusive. A clause cannot confer jurisdiction on a court that has none.

When a Gurugram resident files in the Delhi High Court

Put simply, the Delhi High Court is available when Delhi is where the case lives. That covers a Delhi FIR, a case before a Delhi district court or family court, an order passed by an authority sitting in Delhi, a contract performed or breached in Delhi, and an arbitration seated in New Delhi. In each of these the Delhi High Court has jurisdiction even if every party lives in Gurugram.

Central government decisions need care. A ministry order passed in Delhi on your representation, a decision of a central regulator headquartered in Delhi, or a CAPF headquarters order will usually support a Delhi writ. But a decision of a central officer posted in Gurugram, such as a CGST officer of the Gurugram commissionerate or a regional office acting in Haryana, belongs in Chandigarh, even though the department's head office is in Delhi.

Advocate B.K. Singh asks Gurugram clients one question before anything else: if the other side wanted to arrest you, sue you or enforce the order, which court would they have to go to? If the honest answer is a Delhi court, the Delhi High Court is usually the right forum. If it is a Gurugram court or a Haryana authority, he will say so, because a petition returned for want of jurisdiction costs months, and sometimes the limitation for the proper remedy.

Delhi FIRs, Gurugram residents

Many Gurugram professionals face Delhi FIRs: a cheating complaint by a client in Nehru Place, a cyber complaint investigated by Delhi Police's IFSO unit, or a dowry case filed by a wife at a police station near her parents' home in Janakpuri or Rajouri Garden. Because the FIR is in Delhi, every High Court remedy is in Delhi. The application for anticipatory bail in the Delhi High Court under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (old Section 438 CrPC) is filed in Delhi, usually after the sessions court has been approached.

Matrimonial complaints in Delhi often go first to the Crime Against Women cell of the district police for counselling before an FIR is registered. That stage is an opportunity: you can attend, place your side, and explore settlement. The Supreme Court in Shivangi Bansal v. Sahib Bansal (2025) endorsed safeguards against immediate coercive action in such cases, including a cooling period and family welfare committees, but practice in Delhi may vary, so do not assume protection. Where the dispute has been settled, a petition to quash a 498A FIR in the Delhi High Court under Section 528 BNSS (old Section 482 CrPC) is the usual route.

If the FIR is in Gurugram, the position flips. Bail and quashing go to the Punjab and Haryana High Court, even if you live in Vasant Kunj. Under Priya Indoria v. State of Karnataka (2023), a Delhi court may grant limited interim protection to a Delhi resident so that he can approach the court with jurisdiction, but that protection is short and conditional. Plan to file in Chandigarh within the time given.

Gurugram companies: jurisdiction clauses, arbitration seats and Delhi suits

Gurugram is a corporate city. Its businesses sign service agreements, vendor contracts and leases with parties all over India, and a large share of those contracts name courts in New Delhi or a New Delhi seat of arbitration. In BGS SGS Soma JV v. NHPC (2019) the Supreme Court treated the choice of a seat as a choice of the courts at the seat. So a Gurugram company in an arbitration seated in New Delhi files its Section 9 application for interim relief, its Section 11 petition for appointment of an arbitrator and its Section 34 challenge to the award in the Delhi High Court. The sister site on arbitration practice covers those stages in more depth.

Without an arbitration clause, a commercial suit above Rs 2 crore against a Delhi party, or arising from a contract performed in Delhi, can be filed in the Commercial Division of the Delhi High Court. Suits of lower value go to Delhi district commercial courts. The present limit is Rs 2 crore and a proposal to raise it is pending, so check before filing. Pre-institution mediation under Section 12A of the Commercial Courts Act 2015 is required unless you need urgent interim relief.

Brand owners in Gurugram often prefer to sue in Delhi, where the High Court has an Intellectual Property Division. Section 134(2) of the Trade Marks Act 1999 and Section 62 of the Copyright Act 1957 allow a suit where the plaintiff carries on business, but in Indian Performing Rights Society v. Sanjay Dalia (2015) the Supreme Court held that a plaintiff with offices in several places should sue where the cause of action arose if it has an office there. A Gurugram company selling through a Delhi office, or facing infringing sales in Delhi, can usually file a trade mark infringement suit in Delhi.

IGI Airport: customs, Look Out Circulars and travel stops

Gurugram's residents fly out of IGI Airport, which is in Delhi. Anything that happens to you at the airport is therefore a Delhi matter. A customs seizure of gold or electronics, a detention under the Customs Act 1962, or a demand for duty is decided by customs officers at IGI, and the bail, appeal or writ that follows is in Delhi courts and the Delhi High Court. Our page on customs and DRI cases at Delhi airport explains the stages.

If you are stopped at immigration because of a Look Out Circular, the right forum depends on who asked for it. A circular requested by a Delhi agency can be challenged in Delhi. One requested by Gurugram police in a Gurugram case is more naturally challenged in Chandigarh, and the Delhi High Court may decline it on forum conveniens. Bank-requested circulars are an area where the law is still developing; check the current position before relying on any single ruling.

Gurugram matters that belong in Chandigarh

Some matters will never be heard in Delhi, however close it is. A builder delay or refund dispute on a Gurugram project goes to the Haryana Real Estate Regulatory Authority at Gurugram, then to the Haryana Real Estate Appellate Tribunal, and then by second appeal under Section 58 of the Real Estate (Regulation and Development) Act 2016 to the Punjab and Haryana High Court. Licence, change of land use and external development charge disputes with DTCP, plot disputes with HSVP, and property tax and building plan disputes with the Municipal Corporation of Gurugram or GMDA are writ matters for Chandigarh.

Haryana GST and excise matters, Haryana stamp duty, Haryana police FIRs, Haryana government service disputes and land acquisition in Gurugram all go to the Punjab and Haryana High Court too. Disputes over Gurugram property also stay in Gurugram courts, because Section 16 of the CPC ties suits about land to the place where the land lies. Our page for Faridabad residents deals with the same split for that district.

Consumer complaints are a small exception. Claims above Rs 2 crore go to the National Consumer Disputes Redressal Commission in Delhi, and its orders in an appeal or revision can be challenged under Article 227 in the Delhi High Court. Orders of the Haryana State Commission in Panchkula stay with Chandigarh.

Matrimonial cases split between Gurugram and Delhi

When a Gurugram husband and a Delhi wife separate, cases are often filed in both places. Section 19 of the Hindu Marriage Act 1955 lets a wife file where she lives; maintenance under Section 144 BNSS (old Section 125 CrPC) and domestic violence cases can also be filed where she resides. The husband may file in Gurugram where the couple last lived. Appeals from the Delhi family court go to a Division Bench of the Delhi High Court within 30 days under Section 19 of the Family Courts Act 1984; appeals from Gurugram go to Chandigarh.

Neither High Court can bring the other state's case to its own courts. A transfer of a matrimonial case between Gurugram and Delhi can be ordered only by the Supreme Court, under Section 25 of the CPC for civil cases and Section 446 BNSS (old Section 406 CrPC) for criminal ones. Courts often consider the wife's convenience, the presence of young children, and whether hearings by video can reduce travel. Filing that petition early, before evidence starts in both courts, usually saves effort.

Service matters: central employees, CAPF personnel and Haryana staff

Gurugram and Manesar host offices and camps of several central forces and departments. Central government civil employees go first to the Central Administrative Tribunal bench that covers their place of posting; only an order of the Principal Bench in Delhi, or a matter with a Delhi cause of action, then comes to the Delhi High Court by writ. CAPF personnel of the BSF, CRPF, CISF, ITBP and SSB are outside the tribunal and file writs directly in a High Court. When the order is passed at the force's Directorate General in Delhi, the Delhi High Court usually has jurisdiction; see our page on CAPF service matters in the Delhi High Court.

Employees of the Haryana government, Haryana boards and corporations, and Haryana government schools take their disputes to the Punjab and Haryana High Court. Private sector employees with wage, termination or gratuity disputes go to the labour authorities in Gurugram, with writs to Chandigarh.

Cheque bounce and money claims by Gurugram businesses

Unpaid invoices are the most common dispute for small Gurugram businesses, and the forum often surprises them. Under Section 142(2) of the Negotiable Instruments Act 1881, a cheque bounce complaint is filed where the payee's bank branch that presented the cheque for collection is located. A Gurugram trader who banks with a branch in Kirti Nagar or Connaught Place will therefore file in a Delhi court, and a revision or appeal from that court comes to the Delhi High Court. Our page on cheque bounce appeals and revisions covers that stage. If the account is with a Gurugram branch, the complaint stays in Gurugram.

Civil recovery follows Section 20 of the CPC. You can sue where the buyer is located or where the cause of action arose, which includes where the goods were delivered or where payment was due. A Gurugram supplier delivering to a Delhi warehouse can usually sue in Delhi. If the claim is a commercial dispute of Rs 3 lakh or more, the Commercial Courts Act applies, with pre-institution mediation first. Before choosing, look at the purchase orders and invoices: a printed line saying disputes are subject to one city's courts is often treated as part of the bargain.

How a Gurugram matter reaches the Delhi High Court with us

We decide the forum first and draft second.

  1. Share the papers

Send the FIR, notice, order or contract by WhatsApp or email. Mark the dates: when it was issued, when you received it, and any date fixed for appearance or reply.

  2. Forum and limitation check

We identify where the cause of action arose and which High Court has jurisdiction, and we check deadlines such as the 30-day family appeal limit or the period under Section 34 of the Arbitration Act. If the forum is Chandigarh, we tell you so.

  3. Consultation in Dwarka or by video

Our Dwarka office is the nearest to Gurugram. Advocate B.K. Singh goes through the file, explains what the High Court can and cannot do, and the fee is agreed in writing for each stage.

  4. Drafting and e-filing

We prepare the petition with certified copies, an affidavit and the court fee, and file it through the Delhi High Court e-filing portal. Companies need a board resolution or authority letter for the signatory.

  5. Mentioning and hearings

Urgent matters such as anticipatory bail or a Section 9 injunction can be mentioned for early listing. Other matters are listed in the ordinary course, and many dates can be attended by video.

  6. Compliance and next steps

After each order we explain what it requires, such as joining investigation, depositing an amount or filing a reply, and what remedy lies against it, including a Letters Patent appeal or a Supreme Court petition.

A Gurugram engineer with cases in two High Courts

Here's a made-up example. Vikram, a software engineer, lives in a society in Sector 65, Gurugram. His wife returns to her parents in Janakpuri and files a complaint of cruelty and dowry demands. After counselling at the Crime Against Women cell fails, an FIR under Sections 85 and 86 BNS (old Section 498A IPC) is registered at a West Delhi police station. Vikram's anticipatory bail goes to the Delhi sessions court and then the Delhi High Court. If the couple later settle, the quashing petition is also filed in Delhi.

Meanwhile his employer, a Gurugram company, has a dispute with a vendor over a software contract that names New Delhi as the seat of arbitration. The company's Section 9 petition goes to the Delhi High Court, though both parties have offices in Gurugram.

Vikram's own flat, booked in a project on the Dwarka Expressway in Gurugram, is two years late. That complaint goes to HRERA Gurugram, and any second appeal to Chandigarh. One person, one city, three disputes: two in Delhi, one in Haryana.

Getting to Sher Shah Road from Gurugram

The Yellow Line runs from Millennium City Centre Gurugram through Sikanderpur and Rajiv Chowk to Central Secretariat; from Rajiv Chowk, the Blue Line takes you to the Supreme Court metro station (formerly Pragati Maidan), and from Central Secretariat the Violet Line goes to Khan Market. Both are a short auto ride from the Delhi High Court. By road, NH-48 via Dhaula Kuan takes about an hour outside peak hours; mornings are slower. Litigants need an entry pass and identity proof at the gate.

Many Delhi High Court hearings are hybrid. Your lawyer attends on most dates, and you will usually be asked to come only for settlement quashing, some family matters or when the court wants to record a statement.

Our Dwarka office for Gurugram clients

Our Dwarka office in Sector 7, near Ramphal Chowk, is a short drive from Palam Vihar, the Dwarka Expressway sectors and Udyog Vihar. We also have an office in Vaishali, Ghaziabad, and offer online consultations for clients who cannot travel during working hours. Our guide to meeting a Delhi High Court lawyer near Dwarka has directions, and our page for South-West Delhi and Dwarka covers cases from the Delhi side of the border.

Fees are discussed at the first meeting and agreed in writing, stage by stage. Court fees for bail, quashing and writ petitions are small fixed amounts; for suits they depend on the value claimed, so check the current court fee.

Mistakes Gurugram clients make

  • Choosing the closer court. A writ against HSVP or a Gurugram police FIR filed in Delhi will be returned, however short the drive.
  • Ignoring the arbitration seat. If the contract names New Delhi as the seat, Gurugram courts will not hear your Section 9 or Section 34 petition.
  • Skipping the CAW cell. Not attending counselling in a Delhi matrimonial complaint often leads straight to an FIR, and the court notices who stayed away.
  • Letting two matrimonial cases run in two states. A Supreme Court transfer petition is easier before evidence starts in both courts.
  • Assuming the head office makes it a Delhi case. A CGST officer in Gurugram or a bank branch in Cyber City acts in Haryana. Advocate B.K. Singh has seen petitions lose a year on this point alone.

What to do this week

Collect the FIR, order or contract and write down where it was issued, where it will be enforced and any deadline. If you have a notice to appear before Delhi Police, a 30-day appeal period running or an arbitration notice, do not wait. Gather proof of where you live and work, which often matters for jurisdiction and bail conditions.

Then bring the papers to Dwarka or send them by WhatsApp. For advice on your papers, or for updates on how the Delhi High Court is deciding jurisdiction questions, contact Advocate B.K. Singh.

Frequently asked questions

Can a Gurgaon resident file a case in the Delhi High Court?

Yes, if the case is pending in a Delhi court or the cause of action arose wholly or partly in Delhi. Your Gurugram address does not stop you. A Gurugram police FIR or an HSVP dispute, though, belongs in the Punjab and Haryana High Court.

Which High Court hears a Gurugram police FIR?

The Punjab and Haryana High Court at Chandigarh. Anticipatory bail, regular bail after the Gurugram sessions court, and quashing all go there. A Delhi court may give short interim protection to a Delhi resident in rare cases, only to let him reach Chandigarh.

My company is in Gurugram but the contract says Delhi courts. Is that valid?

Generally yes, if Delhi courts also have jurisdiction because some part of the cause of action arose there or the other party is located there. A clause cannot give jurisdiction to a court that has none. An arbitration seated in New Delhi sends court applications to the Delhi High Court.

Can I file a HRERA Gurugram appeal in the Delhi High Court?

No. Orders of HRERA Gurugram go to the Haryana Real Estate Appellate Tribunal, and second appeals go to the Punjab and Haryana High Court. Delhi has no role in Gurugram real estate disputes unless a separate Delhi cause of action exists.

Is the Punjab and Haryana High Court hearing cases online?

It hears many matters by video conferencing, though practice varies by bench and type of case. Check with a lawyer who practises in Chandigarh. For Delhi High Court matters, hybrid hearings are common.

How can I move my wife's Delhi case to Gurugram?

Only the Supreme Court can transfer a case between Delhi and Haryana. It decides on factors such as the wife's convenience, children and the possibility of video hearings. Within Delhi, the Delhi High Court can transfer a case between districts.

Customs seized my gold at Delhi airport. Which court do I go to?

Customs proceedings at IGI Airport are in Delhi, so any bail, writ or appeal is in Delhi courts and the Delhi High Court. Appeals on duty and confiscation go through the departmental appeal and CESTAT first, with limited routes to the High Court.
