Cases at the Delhi High Court, explained and handled

Bail refused, an FIR that should never have been filed, a Look Out Circular at the airport, a sealing notice, a property suit or an appeal against a family court order. We take Delhi High Court cases from the first draft to the final order, and to the Supreme Court if needed.

We appear before the Delhi High Court, the Supreme Court of India and Delhi's district courts, from Patiala House and Rouse Avenue to Saket, Dwarka and Tis Hazari. This is a private law firm website, not the court's official site.

How a Delhi High Court case usually runs

  1. Reading the papers

We read the FIR, order, notice or decree, check limitation and jurisdiction, and tell you plainly what the High Court can and cannot do.

  2. Drafting and filing

The petition, appeal or suit is drafted with every document relied on, e-filed, and defects raised by the registry are cured quickly.

  3. Urgent listing and first hearing

Where there is real urgency we mention the matter. At the first hearing the court may issue notice and pass interim protection.

  4. Replies, status reports and arguments

The police, the government or the other side files a reply or status report; we answer it and argue the case on the record.

  5. Order and what follows

After the order we explain its effect, ensure compliance, and advise on an appeal, LPA or Supreme Court petition where needed.

Frequently asked questions

Can I go straight to the Delhi High Court for bail?

Usually you first apply to the Sessions Court. The High Court and the Sessions Court both have bail powers under Section 483 BNSS (old Section 439 CrPC), but the High Court generally expects the Sessions Court to be approached first unless there is a special reason. If the Sessions Court refuses, the bail application goes to the High Court.

When can the Delhi High Court quash an FIR?

Under Section 528 BNSS (old Section 482 CrPC) the High Court can quash an FIR when it discloses no offence, is plainly malicious, or is a civil dispute dressed up as a crime. Matrimonial, cheque bounce and many money disputes can also be quashed after a genuine settlement. Serious offences against society are generally not quashed on compromise.

Which civil cases are filed directly in the Delhi High Court?

Suits valued above Rs 2 crore are filed on the original side of the Delhi High Court; smaller suits go to the district courts. Commercial suits above that value go to its Commercial Division and IP suits to its Intellectual Property Division. Check the current pecuniary limit before filing.

Can I file a writ in the Delhi High Court if I do not live in Delhi?

Yes, if the whole or part of the cause of action arose in Delhi, or the order was passed by a ministry or authority in Delhi. Under Article 226(2) the court looks at where the action happened, not only where you live. It can still decline a case that belongs more naturally to another High Court.

How long does a case take in the Delhi High Court?

Bail and urgent matters are usually listed within days. Quashing petitions and writs commonly take a few months to a year or more, depending on replies from the police or the government. Original side suits and appeals take longer. Interim orders can protect you while the case is pending.

Is this the official website of the Delhi High Court?

No. This is the website of B.K. Singh & Associates, a private law firm. For official case status, cause lists and e-filing, use the Delhi High Court's own website.
